§ 1 Scope of Application
For the business relations between OldSpeed.de, Hindenburgstr. 17, D-72762 Reutlingen (in the following called "OldSpeed") and for the orderers apply the following general business and use conditions. OldSpeed does not recognize deviating conditions of the orderer, unless OldSpeed would expressly have agreed their validity in writing.
§ 2 Delivery / Shipment
(1) Delivery takes place within germany and serveral european countries which can be seen on the website.
(2) Deliveries are forwarded by carriers selected by OldSpeed. With order values under 250 euro for supplies within Germany we compute weight-dependent postage flatrate, which are added automatically in the shopping cart. Starting from an amount of 250 euro we supply you within Germany postage and freight-free.
(3) Deliveries abroad Europe: Here we apply likewise weight-dependent transport costs, which are computed automatically in the shopping cart.
(4) Delivery takes place in a period of 14 days. Although the supply will usually faster take place (two to three working-days), we reserve us also a longer delivery time expressly.
§ 3 Prices
(1) In the case of supply in states of the European Union all prices contain the legal value added tax resulting in Germany at a value of 16%.
(2)
In the case of supplies in non-European Union states we reserve ourselves after the valid legal regulation to do without the document of identification of the value added tax. The European Union valid gross price correspond to the net prices in the case of supplies into non-European Union countries . The value added tax due in the recipient country must be paid if necessary with the receipt additionally. Relevant for the value added tax is the calculation address indicated on the order.
§ 4 Payment
(1) The payment takes place by prepayment (3% discount), cash on delivery or Paypal.
(2) The purchase price is immediately due without discount.
(3)
The customer comes into delay without further explanation on the part of OldSpeed 14 days after supply of the commodity, as far as he did not pay. The consequences herein depend on the legal regulations.
(4)
As far as the manner of payment selected by the customer is not feasible despite stipulated execution on the part of OldSpeed especially because a deduction of the customers account is not possible for its lack of covering or because of indication of wrong data, the customer has to replace thereby developing extra costs to OldSpeed or from it with the completion assigned third party.
(5) OldSpeed is justified to avail itself with the completion of the payment of the services of a trustworthily third.
a) With delay of payment of the customer OldSpeed may transfer its demands on a debt collecting agency transfer the personal data necessary for the paymentprocess on this third.
b)
In case OldSpeed is bringing in engagement of third for payment-clearing, the payment in proportion to OldSpeed applies only then as performed out if the amount was put as stipulated at the disposal of this third, so that third can dispose without reservation over it.
§ 5 Right of revocation
(1)
The customer has the right to revoke his order without indication of reasons in writing by letter, fax or E-Mail or by return of the goods within 14 days. The period begins with receipt of the goods, however not before receipt of a written instruction over the right of revocation. For keeping the period sending off of the revocation in time meets the requirement. The revocation is to direct to the address specified above by letter, E-Mail or fax.
(2) Returns with unpaid postage are only accepted by OldSpeed on expressly written arrangement by the OldSpeed service-staff.
§ 6 Warranty / Complaints
(1)
Obvious, in particular visible lack of the supplied commodity (product- and printfaults) including transport damages can be complained under specification by letter, fax or E-Mail.
(2)
By failure of replacement-supply the customer can require on his choice either purchase price reduction or cancellation of the contract (transformation). With a transformation the commodity must be completely sent back to OldSpeed. In the case of lack of quality OldSpeed will transfer the postage costs on fair trading basis; these are to be paid first by the customer and are refunded afterwards by OldSpeed for the account of the buyer .
(3) Returns with unpaid postage are only accepted by OldSpeed on expressly written arrangement by the OldSpeed service-staff.
§ 7 Technical and formal deviations
During the fulfillment of a contract we keep ourselves expressly the right for deviations in relation to the descriptions and data in our folders, catalogs and other written and electronic documents regarding material condition, color, weight, dimension, design or similar characteristics, as far as these are within a reasonable manner for the orderer.
§ 8 Fulfillment
For the fulfilment of its obligations as salesmen OldSpeed reserves itself co-operation with third.
§ 9 Place of jurisdiction
(1)
If the contracting party is a merchant, the exclusive area of jurisdiction is Reutlingen/Germany for all disputes from the present treaty. The offerer remains entitled to raise or introduce complaint or other judicial procedures at the general area of jurisdiction of the contracting party.
(2) German right is applied under exclusion of the UN-Kaufrecht, even if a customer orders from a foreign country.
§ 10 Ineffectiveness in part
If one of the regulations of this agreement should be or become ineffective or impracticable, then the effectiveness or feasibility of the remaining regulations remains unaffected. In this case the parties will agree upon an economically approximating regulation of the ineffective or impracticable regulation if possible. Same applies to possible regulation gaps. |
